General Terms and Conditions – Please read carefully!
What are your rights as a consumer when you order a product from us? What can you expect from us, and what can we expect from you? You can read all about it in the conditions below.
These General Terms and Conditions of Stichting Webshop Keurmerk have been established in consultation with the Consumers' Association and NTO as part of the Self-Regulation Coordination Group (CZ) of the Social and Economic Council and are effective for Stichting Webshop Keurmerk as of July 1, 2012.
These General Terms and Conditions are used by all members of Stichting Webshop Keurmerk, except for financial services as referred to in the Financial Supervision Act and insofar as these services are supervised by the Authority for the Financial Markets.


ARTICLE 1 – Definitions

In these terms and conditions, the following terms have the following meanings:

  • Reflection period: The period within which the consumer can exercise the right of withdrawal;

  • Consumer: The natural person who is not acting in the exercise of a profession or business and enters into a distance contract with the entrepreneur;

  • Day: Calendar day;

  • Long-term transaction: A distance contract relating to a series of products and/or services, of which the obligation to deliver and/or purchase is spread over time;

  • Durable data carrier: Any means that enables the consumer or entrepreneur to store information addressed to them personally in a way that makes future consultation and unchanged reproduction of the stored information possible;

  • Right of withdrawal: The consumer’s possibility to withdraw from the distance contract within the reflection period;

  • Entrepreneur: The natural or legal person who is a member of Stichting Webshop Keurmerk and offers products and/or services to consumers at a distance;

  • Distance contract: An agreement concluded within the framework of a system organized by the entrepreneur for distance sales of products and/or services, where only one or more means of distance communication are used up to and including the conclusion of the agreement;

  • Means of distance communication: A tool that can be used to conclude an agreement, without the consumer and entrepreneur being together in the same place at the same time.

ARTICLE 3 – Applicability

  1. These general terms and conditions apply to every offer of the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.

  2. Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the distance contract is concluded that the general terms and conditions can be viewed at the entrepreneur and will be sent free of charge as soon as possible at the consumer’s request.

  3. If the distance contract is concluded electronically, in deviation from the previous paragraph and before the distance contract is concluded, the text of these general terms and conditions may be made available to the consumer electronically in such a way that the consumer can easily store them on a durable data carrier. If this is not reasonably possible, it will be indicated before the distance contract is concluded where the general terms and conditions can be viewed electronically and that they will be sent free of charge electronically or otherwise at the consumer’s request.

  4. In the event that, in addition to these general terms and conditions, specific product or service conditions also apply, the second and third paragraphs apply mutatis mutandis, and in case of conflicting general terms and conditions, the consumer can always rely on the applicable provision that is most favorable to them.


ARTICLE 4 – The Offer

  1. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.

  2. The offer contains a complete and accurate description of the offered products and/or services. The description is sufficiently detailed to allow a proper assessment of the offer by the consumer. If the entrepreneur uses images, these are a true representation of the offered products and/or services. Obvious errors or mistakes in the offer do not bind the entrepreneur.

  3. Each offer contains such information that it is clear to the consumer what rights and obligations are attached to the acceptance of the offer. This includes in particular:

    • the price including taxes;

    • any delivery costs;

    • the manner in which the agreement will be concluded and what actions are required for this;

    • whether or not the right of withdrawal applies;

    • the method of payment, delivery, and execution of the contract;

    • the period for accepting the offer, or the period within which the entrepreneur guarantees the price;

    • the rate for distance communication if the costs of using the means of distance communication are calculated on a basis other than the basic rate for the used means of communication;

    • whether the contract will be archived after its conclusion and, if so, how it can be accessed by the consumer;

    • the manner in which the consumer can check and, if desired, rectify the data provided in the context of the contract before conclusion;

    • any other languages in which, in addition to Dutch, the agreement can be concluded;

    • the codes of conduct to which the entrepreneur has submitted and the way in which the consumer can consult these codes of conduct electronically; and

    • the minimum duration of the distance contract in case of a long-term transaction.
